Yaser Ammar Ismail ....for the State Mr. Sauradeep Dutta Mr. Himadree Ghosh ....for the de facto complainant Learned counsel appearing on behalf of the petitioner submits that the de-facto complainant had earlier lodged an FIR against the petitioner and others over cutting of trees. The petitioner has been falsely implicated in this case.

Learned counsel appearing on behalf of the de-facto complainant strongly opposes the prayer for anticipatory bail. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the case diary and points to the injury report which shows, among other things, stab injury with knife at the upper chest of the victim. In the statement of the victim recorded before the learned Magistrate she clearly states about the role of the petitioner in assaulting her and in attempting to commit rape.

Considering the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
