Leave granted to the advocate on record for the petitioner to implead the Secretary, West Bengal Board of Primary Education as party respondent in the instant writ petition. Formality of serving copy of the writ petition upon the added respondent stands dispensed with as the Board is duly represented by the learned advocate.

The petitioner complains that the application filed for transfer on medical ground is pending consideration at the end of the West Bengal Board of Primary Education.

Without going into the merits of the said application, the instant writ petition is disposed of by directing the Secretary of the West Bengal Board of Primary Education to consider the application made by the petitioner in accordance with law at the earliest but positively within six weeks from the date of communication of this order.

If the petitioner is found eligible for transfer, then necessary consequential steps shall be taken forthwith.

Learned advocate for the petitioner is directed to forward a copy of the application seeking transfer to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
