Learned counsel for the West Bengal Transport Corporation Limited submits that in terms of the order dated 21st August, 2023 of a coordinate Bench of this Court report of the Managing Director could not be filed. 2.

The reason cited, therefor, is that the impugned order dated 29th May, 2023, refusing compassionate appointment to the writ petitioner on account of his deceased father's employment, is being reconsidered by the authorities. The said order was communicated to the writ petitioner on 31st May, 2023.

In view of the fair and candid admission of the counsel for the respondents, this Court is of the view that the said order dated 29th May, 2023, communicated to the writ petitioner vide a letter dated 31st May, 2023, is liable to be quashed and set aside.

The respondents may take a suitable decision on the petitioner's appointment on compassionate ground within a period of one month from date mandatorily and positively and a reasoned order may be passed and communicated to the writ petitioner.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
