Affidavit of service filed on behalf of the petitioner is taken on record.

It appears that some of the private respondents living at the same addresses as the others could not be served with a notice.

Learned counsel appearing on behalf of the petitioner submits as follows. The respondent no.6 is the daughter in law of the petitioner, the respondent no.7, the father of the respondent no.6, the respondent no.8, the mother and the respondent no.9, the elder brother of the respondent no.6. The petitioner's son stays outside West Bengal in connection with his work. Taking advantage of this, the private respondents barged into the house of the petitioner, abused and assaulted her. Earlier, the daughter in law had filed a case under Section 498A of the Penal Code. Under such compelling situation, the petitioner's son had also filed a divorce suit against the daughter in law. The private respondents came to the petitioner on several dates with about 40 to 50 musclemen, threatened them with dire consequences and asked them to execute

register a sale deed about the property. The petitioner was constrained to file a proceeding under Section 107 of the Code. The petitioner seeks police protection in this regard. Learned counsel appearing on behalf of the State submits that the police are keeping a close watch in the locality and would take appropriate steps, if complaint is made by the petitioner.

It appears that a case, inter alia, under Section 498A was instituted by the daughter in law. A charge sheet has been submitted for the same.

The petitioner's son has also filed a divorce suit against the respondent no.6.

As regards, the alleged threats, intimidation and assaults committed by the private respondents, the petitioner has already initiated a proceeding under Section 107 of the Code. The police would file a report for the same in due course. Therefore, no further order need be passed in this regard.

However, the police authorities shall keep a sharp vigil at the locale and ensure that no breach of peace takes place and no harm is done to the present petitioner.

With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
