07.06.2021 suman Ct. 19 CRM 7466 of 2014 (Via Video Conference) In Re: an application for bail under Section 439(2) of the Code of Criminal Procedure, 1973.

And In the matter of: Kaushik Roychowdhury ....Petitioner Mr. Prasun Kumar Dutta, Addl. P.P.

Mr. S. Deb Roy ..for the State None appears on behalf of the petitioner.

Nobody represents the State when the matter is called on for hearing.

Since Mr. Prasun Kumar Dutta, learned Additional P. P. is present in the Court, he is requested by this Court to appear in this matter to which he has agreed. The instant application for cancellation of bail in connection with Maheshtala Police Station Case No. 868 of 2013 dated 17th day of October, 2013 under Sections 420/406/120B of the Indian Penal Code was registered on 25th June, 2014. Subsequently, the petitioner did not take any action for cancellation of bail of the opposite parties. In the meantime, almost seven years have elapsed.

Considering the conduct of the petitioner this Court is of the view that the petitioner is not willing to press the instant application.

Accordingly, the application being CRM 7466 of 2014 is dismissed for non-prosecution.
