Mr. Asit Kr. Bhattacharya ...for the petitioner Learned counsel appearing on behalf of the petitioner submits that due to inadvertence, an order passed by the learned Magistrate under the provision of Protection of Women from Domestic Violence Act has been challenged in the revision before this Court. Actually, an appeal will lie under Section 29 of the said Act. In view of the same, the petitioner would not like to press this application and would instead prefer an appeal before the learned Appellate Court in terms of Section 29 of the said Act.

On the prayer of the learned counsel appearing on behalf of the petitioner, the revisional application is dismissed as not pressed.

However, this order shall not come in the way of the petitioner in preferring an appropriate application on the self-same grounds.

On the further prayer of the learned counsel, the Office is directed to return the certified copy of the order-sheet annexed with the revision petition to the learned advocate on record of the petitioner upon usual

undertakings and on furnishing a photostat copy of the same for the record.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
