Matter is heard in presence of the learned advocates representing the petitioner and Damodar Valley Corporation (for short, 'DVC').

Petitioner participated in the selection process for appointment in the post of Junior Engineer Grade-II (Mech) under DVC pursuant to the recruitment notification dated 5th June, 2024.

Learned advocate for the petitioner submits that petitioner offered his candidature as per aforesaid recruitment notification dated 5th June, 2024 and participated in Computer Based Test (CBT) and was shortlisted for his participation in the next round of selection process.

It is further submitted on behalf of the petitioner that after document verification by the concerned authority of DVC petitioner was not called for vivavoce and police verification as a result whereof petitioner's candidature for the post of Junior
Engineer Grade-II (Mech) was ultimately not considered. It is also submitted that petitioner needs to be considered against the said post of Junior Engineer Grade-II (Mech) in terms of the recruitment notification dated 5th June, 2024.

Learned advocate representing DVC has opposed this writ petition on the score that petitioner does not have requisite qualification of three years full time Diploma in Engineering/Technology in Mechanical Engineering.

In this regard, attention of this Court has been drawn to a certificate of the petitioner which is at page 16 of the writ petition and it is contended that petitioner does not have Diploma in Engineering/ Technology in Mechanical Engineering rather petitioner possesses Diploma in Mechanical Engineering (Production).

It is also submitted on behalf of DVC in reference to relevant part of the recruitment notification dated 5th June, 2024 that equivalent Diploma certificate holder is not eligible for being recruited against the post of Junior Engineer Grade-II (Mech).

A recruitment notification was issued by the concerned authority of DVC on 5th June, 2024 for filling up certain posts including Junior Engineer
Grade-II (Mech) prescribing requisite qualification of three years full time Diploma in Engineering/ Technology in Mechanical Engineering from any recognized College/Institute approved by AICTE/ appropriate statutory authority with not less than 65 per cent marks (General/OBC(NCL)/EWS)/ 60 per cent marks (SC/ST/PwBD) taking average of all the semesters, irrespective of the weightage given to any particular semester/year by the Institute/University. 9.
On perusal of certificate of technical education of the petitioner it appears that petitioner is possessing Diploma in Mechanical Engineering (Production) which is not a Diploma in Engineering/ Technology in Mechanical Engineering.

It is also clarified in the recruitment notification dated 5th June, 2024 that equivalent Diploma certificate holder is not eligible to be appointed in the post of Junior Engineer Grade-II (Mech).

As it was found by the concerned authority of DVC that petitioner does not possess requisite qualification in technical education in terms of the recruitment notification dated 5th June, 2024, petitioner was not found eligible to be considered against the post of Junior Engineer Grade-II (Mech). 12.
Hence, no relief can be granted to be petitioner.

Writ petition stands dismissed. However, there shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
