The petitioner is in custody for about 108 days in connection with Swarupnagar Police Station Case No.872/ 2021 corresponding to G.R. Case No.4460/2021 under Sections 14/14C of the Foreigners Act.
By an order dated 14th December, 2021, a Co-ordinate Bench of this Court directed the learned Public Prosecutor-inCharge to obtain a report with regard to the genuineness of certain documents, viz, Aadhar card, EPIC card, Ration card etc. submitted by the petitioner in order to prove his citizenship as well as permanent residentship of this Country. A report is submitted by the learned Public Prosecutor-inCharge. I have perused the report though no report is received
from the concerned authority in respect of the Aadhar card of the petitioner, from the report of the competent authority regarding genuineness of Ration card, it is ascertained that the Ration card of the petitioner is genuine and he is a permanent resident of village Jhikra, Post : Dighalgram, Nadia. Considering the above-mentioned documents, the petitioner is enlarged on interim bail of Rs.10,000/- with one surety of like amount to the satisfaction of the Additional Chief Judicial Magistrate, Basirhat with further conditions that he shall attend the Court once in a month and also on the dates of hearing of the case. If the petitioner violates any of the above conditions, the order of bail shall be cancelled without further reference to this Bench.
