Chakraborty Mr. Shashanka Shekhar Saha ...... for the petitioner Mr. Binay Panda Mr. Subham Bhakat ...... for the State We have considered the materials on record. Statements of witnesses disclose recovery of narcotic substance above commercial quantity i.e. 47 Kg. ganja from the joint possession of the petitioner and the co-accused persons.

In view of the aforesaid fact and in the light of the statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner.

The application for bail is thus rejected.
