United Bank Of India v. Ranjit Tribedi
27. 21.06.2022 Ct. No.08 Tanmoy F.M.A. 3694 of 2015 United Bank of India -VersusRanjit Tribedi With IA No: C.A.N. 1 of 2015 (Old No: C.A.N. 7746 of 2015) The appeal is at the instance of the hypothecatee in respect of a vehicle which was financed by the appellant.
The learned trial Judge passed the conditional order for enjoyment of the vehicle by the plaintiff.
The said order under the facts and circumstances does not appear to be unreasonable. In fact, the documents disclosed by the plaintiff would show that the plaintiff had taken loan of Rs.5,27,000/- (Rupees Five Lakh Twenty Seven Thousand) and paid Rs.7,12,553/- (Rupees Seven Lakh Twelve Thousand Five Hundred Fifty Three).
It was on such consideration we find no reason to interfere with the ad interim order passed by the learned trial Court.
The appeal being F.M.A. 3694 of 2015 and the connected application being IA No: C.A.N. 1 of 2015 (Old No: C.A.N. 7746 of 2015) are dismissed.
However, there shall be no order as to costs.
Let urgent Photostat certified copies of this order, if applied for, be made available to the parties upon compliance with all necessary formalities.
