He prays for bail. Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record. Statements of witnesses and contemporaneous document namely, seizure list disclose recovery of narcotic substance i.e. 2.4 liters of codeine mixture above commercial quantity from the joint possession of the petitioner and co-accused. Date has been fixed for recording evidence.

In view of the aforesaid incriminating materials and in the light of the statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. In view of the protracted period of detention suffered by the petitioner, we direct the trial court to conclude the trial as expeditiously as possible preferably within one year from the next

date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
