Report submitted by the learned advocate appearing for the State be kept with the record. Learned advocate appearing for the State submits that pursuant to the complaint being lodged, Rabindra Sarobar Police Station Case No. 25 of 2024 dated 14.02.2024 was registered for investigation.

The police authorities after completing the investigation, has submitted chargesheet on or about September 2024 before the learned Chief Judicial Magistrate, Alipore.

The petitioner complains that he is being threatened by the private respondents who are accused in the present case.

The police authorities have already recorded general diary entries in respect of the complaints regarding the issues relating to threat being inflicted by the private respondents.

In case the petitioner is threatened, it is the duty of the petitioner being the complainant to approach the jurisdictional court for invoking the provisions under Section 232 of the BNS, 2023. It

would be the liberty of the petitioner as such to take appropriate steps before the jurisdictional criminal court in seisin of the matter.

With the aforesaid observations, the writ petition being WPA 19619 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
