It has been brought to the notice of the Court that a hearing was conducted by the Sub Divisional Officer, Sadar Howrah on 27th August, 2025.

The petitioner was provided inspection of the documents relying on which proceeding was initiated for cancellation of the reservation certificate of the petitioner.

Learned advocate for the petitioner submits that, copy of the documents which were used against the petitioner was not supplied to him. According to the State, the enquiry report is confidential and the same cannot be handed over to the petitioner.

The Sub Divisional Officer, Sadar Howrah has forwarded a report wherefrom it appears that certain deeds relied upon by the petitioner standing in the name of his grandfather of the year 1942 has been sent for verification. The verification report is awaiting. 5.
The Sub Divisional Officer is directed to forward a copy of the enquiry report to the petitioner if the contents of the same are used against him for cancellation of the reservation certificate. An opportunity shall be given to the petitioner to defend his stand.

The opportunity to defend is required to be provided to the petitioner to abide by the principles of natural justice.

The authority shall take a decision in the matter at the earliest.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.

The petitioner prays for expeditious disposal of the complaint lodged by him against the reservation certificate issued in favour of the private respondent (Sharadindu Patra).

It appears that the complaint of the petitioner is already under consideration.

The Sub Divisional Officer, Sadar Howrah is directed to dispose of the complaint in accordance with law after giving reasonable opportunity of hearing to all the necessary parties including the complainant and the certificate holder at the earliest.

A reasoned order shall be passed and communicated to all the parties.

The writ petition stands disposed of.
6.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
