Petitioner is directed to serve a copy of the revisional application upon Ms. Das, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularised by the concerned authorities.
Learned advocate for the petitioner submits that the case was initiated in the year 2009 and out of 13 witnesses issued in the charge-sheet, only 4 witnesses have been examined and more than 14 years have been passed. Having regard to the period for which he has been facing trial, I direct the learned jurisdictional magistrate to fix at least one date in every month, so that the trial of the case can be concluded within 2 years from 18th January, 2024. If required, learned trial court would give more than a date in a month so that trial would progress and is allowed to be completed by the schedule so fixed above. If required, the DSP/SDPO of the concerned area in charge of Berhampore Police Station would act as nodal
officer of the case, who would ensure regarding the production of the witnesses on the date so fixed by the learned trial court.
Public Prosecutor conducting the case would make available all the necessary documents, statements, materials and exhibits on the date on which the witness would appear before the court. All stakeholders must cooperate with the court to complete the trial within a reasonable period of time.
With the aforesaid observations, CRR 2941 of 2023 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
