The writ petitioners, five in number, made an application before the Regional Transport Authority, North 24-Parganas, seeking permits for auto rickshaws. Their prayer, however, was rejected by the said authority on the ground that it is the Regional Transport Authority, Kolkata, which has the jurisdiction to grant such permits. Accordingly, the petitioners' prayer was rejected by the Regional Transport Authority, North 24Parganas. I am of the view that since the prayer of the petitioners was not rejected on merits but solely on the ground of jurisdiction, there is no impediment to their approaching the appropriate authority for permits on the concerned route.

I find no justification to keep this writ petition pending. Accordingly, liberty is granted to

the petitioners to apply before the Regional Transport Authority, Kolkata, for grant of permits in respect of their respective vehicles, provided such application is made within three weeks from the date hereof. The Regional Transport Authority, Kolkata, shall consider such prayer in accordance with law within eight weeks thereafter.

Accordingly, the writ petition, being WPA 18903 of 2025, stands disposed of.
