17.08.2022 Court No.13 Item No.721 AP WPA 18257 of 2014 With IA NO: CAN 1 of 2018 (Old No: CAN 3818 of 2018) Sudhir Chandra Das Vs.

The West Bengal Central School Service Commission & Ors.

Mr. Mukunda Lal Sarkar ... For the Petitioner.

Dr. Sutanu Kumar Patra Ms. Supriya Dubay ... For the WBCSSC.

The writ petition has been filed seeking review and re-evaluation of the answer scripts in the subject of Botany and Zoology in the 12th Regional Level Selection Test of the year 2011 for recruitment to the post of Assistant Teachers.

It is now well-settled that review and re-evaluation of answer scripts in any board exam much less in a recruitment test cannot be permitted. Earlier Benches of this Court had spent considerable time looking into various other matters relating to petitioner's candidacy. It is submitted by the counsel for the petitioner that his client belonged to the "Scheduled Caste" category and should also have been given the benefit to his client having worked in "Madhyamik Siksha Kendra"

as a "Samprasarak".

This Court notes that in the option form for the aforesaid selection process i.e. 12th Regional Level

Selection Test of the year 2011, the petitioner indicated in writing that he belonged to the general category and not the scheduled caste category. Documents to the contrary produced by the counsel for the petitioner cannot improve the situation since more than 10 years have elapsed since the selection process has been completed.

The aforesaid issues are even otherwise outside the scope of the writ petition.

In the facts and circumstances, no relief can be granted to the petitioner.

With the aforesaid observations, the writ petition is disposed of.

In view of the disposal of the main writ petition, connected applications, if any, shall also stand disposed of. There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.)
