Report submitted by the State be also kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

Learned advocate appearing for the petitioner is basically aggrieved of the fact that she cannot stay at her own residence.

However, the police report in respect of certain steps taken by the police authorities is in the year 2017, which relates to FIR being registered and final report as mistake of fact being submitted before the jurisdictional court. Considering that the lady/petitioner cannot enter at her own residence, I am of the view that it is the duty of the State to give protection to all its citizens.

Accordingly, if the petitioner reports to the Nager Bazar Police Station at 11 a.m. on 26th September, 2024, police escort be provided to her for entering her residence. A strong vigil be kept so that no harm is committed upon the petitioner at the instance of any person of the area or any of her relations. The police authorities would be responsible for keeping the peace and tranquility in the area and no disturbances should be created or any harassment being inflicted upon the petitioner, if she wants to reside and continues over there at the address stated in the petition.

Further grievances of the petitioner would be addressed, if any, before the learned Chief Judicial Magistrate, Barasat or the learned Additional Chief Judicial magistrate, being the jurisdictional court.

With the aforesaid observations, WPA No.

19575 of 2024 is disposed of.
