Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner made an application for transfer far back on 17th August, 2021 on Utsashree portal. However, petitioner's transfer application could not be processed since petitioner was found to be a single teacher in the subject in the school.

During course of hearing learned advocate representing the petitioner submits that petitioner is an Assistant Teacher of Geography in the school and in the meantime, another teacher has been appointed in Geography.

Respondents are represented by learned advocates. 5.

From the submissions made on behalf of the petitioner it appears today situation is altered due to appointment

of another teacher in Geography in the school. Therefore, petitioner is no more to be treated as a single teacher of Geography in the school.

In view of aforesaid situation, writ petition stands disposed of granting leave to the petitioner to make an application afresh seeking transfer, in accordance with law. If such transfer application is made by the petitioner, in that event Court expects concerned respondent authorities shall take steps based on such transfer application expeditiously.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
