The premise of the challenge in the present writ petition is an alleged over-billing in the final assessment made by the West Bengal State Electricity Distribution Company Limited (in short 'WBSEDCL').

Since, within the parameters of the governing Regulations, an appeal lies before the appropriate authority, WPA 20077 of 2021 is dismissed as not maintainable with liberty to the petitioner to approach the appropriate appellate authority with a challenge against the final assessment.

It is made clear that the merits of the respective contentions of the parties have not been gone into by this Court and it will be open to the appropriate authorities to decide the issue upon hearing the interested parties in accordance with law.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
