In this writ petition, the petitioner has ventilated grievance that from amongst the three schools suggested by him, the respondent/Central School Service Commission has issued transfer order of the writ petitioner to the third suggested school, which is furthest from the residence of the writ petitioner.

The writ petitioner's contention as ventilated by Mr. Biswas, learned advocate appearing for the writ petitioner, today is that he being a patient of major pancreas operation would be more suited if placed in a nearby school than the present school to which he has been transferred.

In this regard, Mr. Biswas has pointed out to the letter of the writ petitioner dated December 2, 2021, in which the writ petitioner again has suggested names of the following two schools which are nearby to his residence and preferred by him, to be transferred on the ground of his ill-health:- (i) Mohisda Ram Narayan High School

(ii) Ghosediha High School 4.

Mr. Biswas, upon instruction, submitted that appropriate vacancy is available in the two schools as mentioned above as suggested by the writ petitioner to be transferred to.

In such circumstances, the Court finds it appropriate to dispose of the instant writ petition by directing the respondent Nos.5, 6 and 7 to pass an appropriate order for transfer of the writ petitioner to any of the above mentioned schools, subject to availability of an appropriate vacancy there as on date.

It is further mentioned that the said respondents shall take all endeavour to transfer the writ petitioner to any other school within 8 km from his residence, if not a suitable vacancy is available in any of the schools suggested by the writ petitioner and mentioned above. 7.

With the directions as above, the writ petition is disposed of.

Consequently all connected pending applications, if any, are also disposed of.

There shall be no order as to costs.
