Learned advocate appearing for the petitioner submits that, four other co-accuseds were enlarged on bail by the Jurisdictional Court. The police filed charge-sheet and, therefore, custodial interrogation of the petitioner is not required.
Learned advocate appearing for the State submits that, the petitioner appeared in the Close Circuit Television (CCTV) footage of the incident. The petitioner was identified as one of the persons participating in the dacoity, by the victims from the photographs of the petitioner collected from the CCTV footage.
In view of the incriminating materials in the case diary as against the petitioner, we are unable to grant anticipatory bail to the petitioner.
In such circumstances, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 4104 of 2022 is dismissed.
