By an order dated 15.9.2021 the Learned Additional Chief Judicial Magistrate, Bidhannagar was pleased to refuse prayer of return of the seized vehicle. Such order has been passed on the basis of a report submitted by the Forest Range Officer. It has been submitted that the present petitioner before this court is not registered owner of the vehicle. I direct that in case registered owner of the vehicle prefers an application for return of the seized vehicle, the learned ACJM, Bidhannagar will consider the same in accordance with law after verifying the relationship between the applicant and the ownership of the vehicle with the Motor Vehicles Department.
Accordingly, CRR 2506 of 2021 is disposed of. All pending connected applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
