1. The report by way of affidavit filed by the Senior Divisional Commercial Manager and the reply thereto filed by the petitioners be taken on record.

2. The contract issued to the petitioners stood terminated on the grounds that they relied upon fake documents at the time of submission of their bid.

The petitioners relied upon a certificate issued by one Director (Government Nominee) of the Bihar Gramin Bank certifying that the experience certificate issued in favour of the petitioners is genuine and accurate.

The railway authority verified the said certificate and found the same to be fake. According to the railways, physical verification at the bank was made by the representative of the railway authority and it was detected that no such certificate was ever issued in favour of the petitioners.

As the documents relied upon by the petitioners on verification of the authority could not be proved, accordingly, the contract of the

petitioners stood terminated.

The petitioner are aggrieved by the same. It has been submitted that the contract ought not to be terminated based on hearsay evidence.

Whether the certificate relied upon by the petitioners is genuine or not cannot be adjudicated by the writ court. The authority has affirmed an affidavit with the averment that the document relied upon by the petitioners is fake. 8.

In view of the above, no relief can be granted to the petitioners. The writ petition fails and is hereby dismissed.
