Banerjee) Mr. Radha Nath Nandy ... the petitioner (in-person) This application under Article 227 of the Constitution of India is at the instance of the plaintiff and is directed against an order dated July 2, 2025, passed by the learned 2nd Judge, Presidency Small Causes Court at Calcutta. By the order impugned, a date has been fixed for hearing on the point of maintainability.

The petitioner appearing in-person submits that the misc. case is maintainable in its present form. He further submits that he has already made submission in support of the maintainability of the misc. case before the learned trial judge.

Since a date has been fixed for hearing on the point of maintainability, this court refrains from making any observation on such issue.

Accordingly, CO 2990 of 2025 stands disposed of by requesting the learned 2nd Judge, Presidency Small Causes Court at Calcutta to take up the

hearing on the point of maintainability on the next date fixed, i.e., on August 29, 2025 and to decide such issue as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
