The petitioner is anxious regarding the progress of the trial.

As the petitioner is in custody since 7th August, 2020 and although charge-sheet was submitted on 7th October, 2020 and supplementary charge-sheet was filed on 15th January, 2021, yet the case has proceeded in a slow pace.

Learned advocate for the petitioner submits that charge was framed on 20th November, 2021 and there are nine witnesses on whom the prosecution intends to rely upon. Mr. Abhra Mukherjee, learned advocate, appears on behalf of the State.

Records reflect that the petitioner is in custody for about 14 months and although charge has been framed, no witness has been examined.

It has been informed that the next date has been fixed on

23rd March, 2022 for evidence.

In view of the date already being fixed, I direct the learned special court to fix the schedule consisting of three dates which should be fixed at least once in every three months so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties and a date/schedule would be fixed after the public prosecutor conducting the case assures the learned special court regarding the availability of the witnesses. With the aforesaid observations, CRR 2509 of 2021 is disposed of.
