The petitioner is aggrieved that her application for transfer has been rejected on the ground that she is a resident of Paschim Medinipur and has applied for transfer to a School located in Nadia.

The Head of the Institution has rejected the application of the petitioner on the ground that given the long distance of the schools chosen by the petitioner, she does not need a transfer. It is also found that pupil-teacher ratio is less than what is accepted under the RTE Act.

The aforesaid are not the grounds for rejection of an application for transfer. The petitioner, since after marriage is now living in Nadia.

In that view of the matter, the Head of the Institution shall forward the petitioner's application for transfer to the concerned District Inspector of Schools (SE) for further action in terms of the 2015 Rules mandatorily and positively within a period of one week from the date of receipt of this order.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
