Petitioners approached this Court being aggrieved by the inaction of the police authorities for not taking appropriate steps so far as the civil rights of the petitioners are concerned.

Learned Senior Advocate appearing for the petitioners submits that they are in possession pursuant to directions passed by the National

Company Law Tribunal, Kolkata Bench on 09.12.2024.

Learned advocate for the private respondent nos. 7 to 9 submits that there are disputes relating to usage of common area, parking space and maintenance.

Learned advocate appearing for the petitioners denies the same and submits that so far as the parking space is concerned there has been a different arrangement. The maintenance charges according to instructions received by the learned Senior Advocate have been paid upto date and there are no issues relating to usage of common area. Police authorities have taken steps as I find that already a case has been registered against the driver and staff of the petitioners being Bhowanipore PS Case No. 133 dated 11.06.2025 and a countercase has also been registered being Bhowanipore PS Case No. 237 dated 16.08.2025. The pendency of both the criminal cases itself reflect that the petitioners and the private respondents are in a strained relationship.

The issues which have cropped up are within the compound of the apartment itself. Police authorities would interfere if there is violation of law and order after assessing the genuinity of the allegations.

With the aforesaid observations WPA 18914 of 2025 is disposed of.

Copies of the report be handed over to both the parties.
