Learned advocate appearing for the petitioner submits that although the petitioner is in custody for 1 year 10 months and other accused persons have been granted bail, but there has been no progress in the trial and the petitioner is unnecessarily languishing in jail. As such, petitioner prays for bail on any stringent condition.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that 113 kgs. of ganja was recovered from the joint possession of the petitioner and others. It has also been pointed out that the accused persons who have been released on bail were granted default bail. As such issues relating to parity do not apply to the present case.

Be that as it may, having considered that commercial quantity of contraband was recovered, provision of Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioner is rejected.

Petitioner would renew his prayer for bail at the appropriate stage.

The application for bail, being CRM (NDPS) 1022 of 2025, is, thus, dismissed.
