This application under Article 227 of the Constitution of India is at the instance of the husband and is directed against an order being no.61 dated 02.05.2025 passed by the learned Additional District Judge, 7th Court, Alipore in Matrimonial Suit No.3142 of 2018.

Mr. Banerjee, learned advocate appearing for the petitioner, submits that after the aforesaid order was passed, the matrimonial suit has been transferred to the learned Additional District Judge, Fast Track, 3rd Court, Alipore.

After some argument, Mr. Banerjee, learned advocate appearing for the petitioner, submits that a direction be passed upon the learned Additional District Judge, Fast Track, 3rd Court at Alipore to dispose of the matrimonial suit and the application for enhancement of alimony, which is still pending, expeditiously.

Mr. Banerjee submits that the application for enhancement of the alimony is fixed for hearing on 10.09.2025 and 15.09.2025 has been fixed for argument in the matrimonial suit.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party.

However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing her before the learned Trial Court. In the light of the submission made by the learned advocate for the petitioner, C.O. No.2993 of 2025 is disposed of without interfering with the order impugned but by requesting the learned Additional District Judge, Fast Track 3rd Court at Alipore to take up the hearing of the application praying for enhancement of alimony on the next date fixed i.e. on 10.09.2025 and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. The learned Additional District Judge, Fast Track, 3rd Court at Alipore shall make an endeavour to dispose of the matrimonial suit as expeditiously as possible without granting any unnecessary adjournment to either of the parties subject to any

order that may be passed in the application for enhancement of alimony.
