For the Respondent No. 3 The petitioners complain that they were employees under the 2nd respondent and superannuated in 2014, 2015 and 2016. No gratuity has been paid to them in terms of Sections 7(2) and 7(3) of The Payment of Gratuity Act, 1972. The petitioners submitted applications in Form N before the Controlling Authority (respondent No. 3 herein) in 2017 and 2018, but the said applications have not been considered as yet. The petitioners pray for a direction upon the Controlling Authority to consider their applications at the earliest. Upon considering the submissions made on behalf of the parties, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the applications filed by the petitioners on merit within a period of three months from the date of communication of this order after giving reasonable opportunity of hearing to all the interested parties including the petitioners, in

accordance with law. The decision taken by the Authority shall be communicated to the petitioners within a week thereof. W.P.A. 20121 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
