The petitioners submits that they are the owners in respect of a plot of land situated at Mouza- Lokhra, JL No.

142 and RS and LR Dag No. 144, 160, 177 and 180, RS Khatian No. 534.

The grievance of the petitioners are that only the signatures of petitioner no.2 and petitioner no.8 have been taken and neither the benefits of transfer of the property have been provided nor any sign and/or signatures of rest of the petitioners were obtained while transferring such

property. The petitioners are aggrieved that inspite of same, the property has been transferred in a fraudulent manner and in conspiracy at the behest of the respondent nos. 4 to 9.

Learned advocate for the State has submitted a report which reflects that the police authorities were not aware regarding such transfer as no information was brought to the notice of the Pukhuria Police Station in the district of Malda.

Be that as it may, since prima facie there are materials in possession of all the petitioners, they would approach the jurisdictional Magistrate under the relevant provisions of Section 175(3) of the BNSS. The learned Magistrate would assess as also ascertain regarding the genuinity of the accusations and/or allegations, thereafter, pass necessary directions upon the police authorities as he/she deems fit and proper.

With the aforesaid observations, WPA 19072 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
