The revisional application was preferred challenging the proceedings arising out of Haripal Police Station Case No. 97 of 2009 dated 20.08.2009.

Record of this revisional application reflects that the petitioners approached this court at the stage when the case was committed from the court of the learned A. C. J. M., Chandernagore to the court of the learned Sessions Judge, Hooghly.

There was no persuation regarding the revisional applicastion before this court and lastly the interim order was passed on 8th May, 2015 for a period of eight weeks.

Thus, from end of July, 2015, there was no interim order in respect of the proceedings. However, the learned trial court has not proceed with the matter.

Having regard to the seriousness of the allegations which incorporates the provisions of Section 306 of the Indian Penal Code in a matrimonial offence, I am of the view that the learned trial court should proceed with the trial. Report submitted by the Sub-Inspector of Police, Haripal P. S., Hooghly Rural District through the learned advocate for the State be kept with the record.

As such, no interference is called for by this court at this stage since there has been change of circumstances. Accordingly, the present revisional application being CRR 2598 of 2012 is dismissed.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
