Mr. Suranjan Mondal Ms. Trina Banerjee ...for the petitioner Learned advocate for the petitioner submits that CNS/2486/2022 under sections 506/406/420/120B IPC has been pending before the learned Metropolitan Magistrate, 19th Court at Calcutta for about one year, and that that there has been hardly any progress in the case and the accused persons have already appeared before the court. He submits that the stage of the case is evidence before charge and that the next date has been fixed on September 11, 2023.

Learned trial court is, therefore, directed to fix the matter on and from September 11, 2023 once date in every 75 days, so that the evidence before charge in respect of the witnesses to be tendered be concluded by September 30, 2024.

As the case involves the procedure of cases instituted otherwise than police report and the cross-examination is not compulsory, in case on the grounds of cross-examination the case is delayed, the learned trial court would proceed to examine the next witness.

With the aforesaid observations, CRR No.2960 of 2023 stands disposed of. Pending application, if any, is also disposed of. Parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
