Affidavit of service filed on behalf of the petitioner is taken on record.

By the present writ petition the petitioner seeks direction upon respondent no.2, Director of Pension, Provident Fund and Group Insurance and respondent no.3, District Inspector of Schools, Primary Education, Burdwan to release family pension in favour of the petitioner.

The petitioner contends that he is a handicapped son of the deceased employee, Md. Monirujjaman who was an Assistant Teacher of Bardhaman Primary School. The petitioner's father expired on 6th May, 1999. The petitioner's mother died on 14th February, 2008. The petitioner approached the pension sanctioning authority on several occasions for grant of family pension. Pursuant thereto, on 10th July, 2024, District Inspector

of Schools, Primary Education, District - Burdwan has forwarded the case of the petitioner to the respondent no.2, Director of Pension, Provident Fund and Group Insurance vide Memo No.PEN/BUR/228 which was duly received by the office of respondent no.2 on 11th July, 2024. However, since then matter is pending consideration. Hence, this writ petition.

Mr. S. Bandopadhyay, learned Advocate appearing for the petitioner submits that specific direction be issued upon respondent no.2, Director of Pension, Provident Fund and Group Insurance to take a decision with regard to the letter dated 10th July, 2024 of District Inspector of Schools, Primary Education, Burdwan. 5.

Mr. Anwari Quraishi, learned Advocate for the State also concedes to such submission.

It is found from Annexure 'P-5' at page 32 of the writ petition that the matter of family pension of the petitioner has been forwarded by District Inspector of Schools, Primary Education, Burdwan to Director of Pension, Provident Fund and Group Insurance on 10th July, 2024. The Director of Pension, Provident Fund and Group Insurance is yet to take a decision with regard to the case forwarded at its end.

Accordingly, respondent no.2, Director of Pension, Provident Fund and Group Insurance is directed to take a decision with regard to the letter issued by District Inspector of Schools, Primary Education, Burdwan under Memo No.PEN/BUR/228 dated 10th July, 2024 in

accordance with law within a period of eight weeks from the date of communication of this order.

Learned advocate for the petitioner is directed to communicate this order to respondent no.2, Director of Pension, Provident Fund and Group Insurance, for necessary action.

The decision shall be communicated to the petitioner within a period of one week thereof.

10. With the aforesaid directions, the writ petition being WPA 19147 of 2025 is disposed of.

11. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

12. Interim order, if any, stands vacated.

13. All connected applications, if any, stand disposed of.

14. There shall be no order as to costs.

15. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
