The State of West Bengal & Ors.

Mr. Sougata Mitra Mr. Rameshwar Sinha Ms. Ankita Dey Ms. Jahanara Begum .....for the petitioner Mr. Bhaskar Prasad Vaisya Mr. Ranjan Saha ......for the State This is an application seeking a direction upon the respondents to consider the application for appointment of the petitioner as an MR Dealer on compassionate ground on the death of his father. Affidavit of service filed on behalf of the petitioner is taken on record.

Report filed on behalf of the State is also taken on record.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner's father was an MR Dealer. He was granted a license in the year 2020. The license was lastly renewed on 30th January, 2021. However, on 29.4.2021 the petitioner's father passed away. Accordingly, the petitioner made an application on 30.06.2021 for grant of license as an MR

Dealer on compassionate ground. The same has not been considered yet.

Learned counsel appearing on behalf of the State submits as follows. The petitioner as well as his brother had applied for MR dealership on compassionate ground. Further, they had not filed relevant documents. Accordingly, notices were given to them. But, the notices did not evoke any positive response.

However, the respondent no. 4 would be not in a position to consider the representation of the petitioner in accordance with law.

I have heard the learned counsels for the parties and perused the writ petition and the report filed by the State.

It appears that both the sons of the deceased MR Dealer had applied for dealership on compassionate ground. The same can fairly be considered and disposed of by the respondent no. 4.

In view of the above and in the interest of justice, I direct the respondent no.4 to consider the representation of the petitioner in accordance with law after giving an opportunity of hearing to the petitioner within a period of three months.

With these observations, the writ petition is disposed of.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
