Ali Ahasan ...for the private respondents The petitioner complains of alleged inaction on the part of the Nimta Police Station in respect of a complaint against the private respondents for trespass.

It appears from the records, that the petitioner had already instituted a suit being T.S. No. 17 of 2002 against the private respondent, one Madhu Talukdar and his family, which is now pending before the learned Civil Judge (Jr. Div.), 3rd Court at Sealdah.

This Court also notes that the dispute between the private respondents and the petitioner is purely civil in nature and the police have no role whatsoever to play in the matter.

The petitioner may pursue his remedy in accordance with law, before the appropriate civil forum.

With the aforesaid observations, the instant writ petition shall stand disposed.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
