...for the appellant/petitioner This is an application under Article 227 of the Constitution of India at the instance of the appellant in the Miscellaneous Appeal No. 151 of 2024, praying for a direction upon the learned Additional District Judge, 14th Court at Alipore to dispose of the miscellaneous appeal expeditiously.

Ms. Sudhesna Basu Thakur, learned counsel appearing for the petitioner submits that repeated dates have been fixed for arrival of the Trial Court Records but till date the Trial Court Records have not yet arrived before the appellate Court.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocates representing the opposite party before the Appellate Court.

The learned Additional District Judge, 14th Court at Alipore is requested to take necessary steps so that the

Trial Court Records are transmitted to appellate Court at the earliest.

The learned Judge of the Appellate Court is further requested to make an endeavour to dispose of this Miscellaneous Appeal No. 151 of 2024 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

With the aforesaid directions, CO No. 2999 of 2025 is disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
