And In Re : Biswajit Gorai Mr. Tanmay Chowdhury Ms. Sulagna Sarkar ... For the Petitioner.
Mr. Debabrata Chatterjeee Mr. Abhishek Verma ... For the State The petitioner is in custody for about 5 years and renews his prayer for bail.
Learned counsel for the petitioner submits that there has not been much progress in trial of the case after his bail prayer was turned down by this Court earlier. Learned counsel for the State opposes the prayer. Bail prayer of the petitioner was turned down by this Court considering the material on record on 29th July, 2022. Thereafter 5 witnesses have been examined in full out of 11 witnesses. There has been considerable progress in trial after the bail prayer was turned down on the earlier occasion. On merits, the petitioner does not deserve a favourable order at this stage.
Accordingly, the prayer for bail is rejected at this stage.
Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.
The application for bail is disposed of.
Case diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
