The petitioner9s application seeking transfer was not allowed by the head of institution on the ground that number of teachers in respect to the number of students in the school is very few. The application was returned to the petitioner on 30th January, 2022.

Learned advocate for the petitioner submits that there are twenty teachers in the school out of which five teachers and one parateacher teach English in the school. According to the petitioner, there is no dearth of English teachers in the school. The petitioner submits that it is absolutely illegal and improper for the school to not issue 8no objection certificate9 in her favour.

It appears from records that the application of the petitioner stood returned way back on 30th January, 2022. More than four years have elapsed from the date the said application was rejected. There may have been change in the staff strength in the meantime.

In view of the above, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to make fresh offline application seeking transfer in the prescribed format disclosing ground for the same. 5.

In the event such an application is made, the same shall be considered by the head of the institution in accordance with law.

Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of receipt of the application from the petitioner.

If the application of the petitioner is allowed, then necessary consequential steps shall be taken without any further delay.

The fate of the petitioner9s application shall be made known to the petitioner.

Suspension of the Utsashree portal will not stand in the way of the respondents to consider the application for transfer made by the petitioner.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

12.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
