(NDPS) 1024 of 2025 In Re:- An application for Bail under section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with NDPS Case No. 91 of 2024 arising out of Baishabnagar Police Station Case no. 1190 of 2024 dated 29.10.2024 under Sections 21(c)/27A/29 of the NDPS Act, 1985.

Mr. Sourav Chatterjee Mr. Amit Ranjan Pati Mr. Surayan Ghosh Ms. Swastika Chowdhury Mr.Anijit Chatterjee Mr.Anish Goswami ...for the Petitioner Ms. Faria Hossain Mr. Dattatreya Dutta ...for the State Mr. Chatterjee, learned counsel appearing on behalf of the petitioner submits that nothing was recovered from the possession of the present petitioner. He further submits that recovery was made from one co-accused Sukur Ali, who was apprehended from the spot and transpiring his statement the present petitioner was arrested. He further submits that the present petitioner has been shown arrested on 12.06.2025 and till that date he is in custody in connection with the present case.

Learned counsel appearing on behalf of the State opposed the bail prayer contending that the statement recorded during investigation transpired that the present petitioner is the main supplier of the narcotic substance. She

further submits that the present petitioner has criminal antecedence in Kaliachak Police Station Case No. 723 of 2024 and also in Kaliachak Police Station Case No. 758 of 2025 under the NDPS Act.

Having heard learned counsel appearing on behalf of the petitioner and the State and that in the event of releasing the petitioner on bail there is every likelihood of committing offence by the petitioner and also on the basis of materials available in the case dairy it appears that the petitioner has failed to overcome the restrictions imposed under section 37 of the NDPS Act, and as such the prayer for bail made by the present petitioner is considered and rejected. Accordingly, CRM (NDPS) 1024 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
