24.09.2025 Court No.28 Item No.24 ssi CRM (A) 2947 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Khargram Police Station Case No.266 of 2025 dated 14.06.2025 under Sections 126(2)/117(2)/118(2)/109(4)/3(5) of the BNS. And In the matter of: Biman Dalui & another.
....Applicants/Petitioners Ms. Ipsita Ghosh ...for the petitioners Mr. Md. Adil Badr Mr. Debanik Das ..for the State Learned counsel appearing on behalf of the petitioners submits that the petitioners have been falsely implicated in this case. In fact, there are case and counter case. The petitioners also received serious injuries.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the case diary and points to the injury report of the victim showing grievous injury. It is alleged that a beer bottle was thrashed on the head of the victim which resulted in such injuries.
Considering the serious nature of allegations and the incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioners is rejected.
