The petitioners allege violation of the order dated December 8, 2023.

From the report that has been forwarded to the Special Secretary to the Department of Urban Development & Municipal Affairs, Government of West Bengal signed on January 10, 2025, it appears that the authority has come to a conclusion that the subject plot of land belongs to the Government so the question of acquisition of the land does not arise. 3.

There is no document to suggest that the order of the department was communicated to the petitioners. The petitioners assert that the plot of land is their private land.

As it appears that the authority already considered the prayer of the petitioners and has come to a finding that the State is the owner of the land, accordingly, the Court is not inclined to proceed with the contempt proceeding any further.

Let a copy of the order of the Special Secretary be formally served upon the petitioners.

It will be open for the petitioners to challenge the same in accordance with law before the competent forum, if so advised.

The contempt application is disposed of.

8.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
