Petitioner complains that although the investigation was transferred but no progress in the investigation has resulted in spite of the investigation being transferred to the CID.

Learned advocate for the State submits that during pendency of the writ petition, police authorities have submitted their report under Section 173 of Cr.P.C. which reflects mistake of fact. Since no case exists as on date and the petitioner is interested to take steps before the jurisdictional court, I am of the view that if an application for further investigation is preferred by the petitioner, the learned jurisdictional court would consider the same in accordance with law preferably within a period of 60 days from filing of the same.

Accordingly, WPA 20569 of 2024 is disposed of.

The information which has been received by the learned advocate for the State by electronic mail be transmitted to the learned advocate appearing for the petitioner.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
