The supplementary affidavit filed by the petitioner be taken on record.

The petitioner has filed the present writ application praying for a direction upon the respondents for issuance of work order in favour of the petitioner being the highest bidder with respect of the work namely, tank bunds from Ashapur to Khanpur Ramp of the Mahananda Dam, P.S. Chanchal, District - Malda. 3.

The petitioner submits that the authorities have published notice inviting tender and accordingly, the petitioner has participated in the said tender. On opening of the tender, it was found that the petitioner is the highest bidder and the bid amount was Rs. 8,25,500/- but in spite of the same, till date the authorities neither rejected the tender process not issued the work order in favour of the petitioner in spite of having knowledge that the petitioner is the highest bidder.

The learned counsel appearing for the State has submitted the report and submits that at the time of

opening of the tender on July 16, 2025 some unknown miscreants entered into the room of the Executive Engineer and snatched all the tender process including the papers of the petitioner. Accordingly, the SDO has made a complaint to the police authority and the police authority has initiated an FIR and the case is under investigation.

He further submits that till date the authorities have not taken any decision for issuance of the fresh tender. The grievance of the petitioner in the present writ application is that the petitioner has already made a representation to the Executive Engineer but the said representation has not been considered.

In view of the above, this Court finds that no purpose would be served by keeping the writ petition pending. Accordingly, WPA 18839 of 2025 is disposed of by directing the respondent no. 3, i.e., the Executive Engineer, Irrigation and Waterways Directorate of Mahananda Embankment Division, Green Park, Malda to consider the representation submitted by the petitioner and to pass a reasoned and speaking order after giving an opportunity of hearing to the petitioner within a period of four weeks from the date of receipt of this order.

Accordingly, WPA 18839 of 2025 is disposed of. 8.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
