The writ petitioner was removed from service by an order dated May 18, 2022 passed by the Additional Commissioner & Regional Director, Employees' State Insurance Corporation/respondent no.4.

The writ petitioner preferred a statutory appeal before the Director (Administration), Employees' State Insurance Corporation on June 3, 2022.

Mr. Sanyal, learned counsel, appearing for the writ petitioner prays for early disposal of the statutory appeal. Mr. Prasad, learned counsel appears on behalf of the respondent nos.2 to 5.

Ms. Gupta, learned counsel appears on behalf of the respondent no.1.

Let the statutory appeal filed by the writ petitioner be disposed of within 3 months from date with an opportunity of hearing being given to the writ petitioner and/or his delegated representative as per the extant rules of the respondents.

Needless to mention, the statutory appeal be disposed of with a reasoned order and shall be communicated to the writ petitioner/delinquent employee within 2 weeks of passing thereof.

Since no affidavits have been invited in the writ petition, let the allegations contained therein be deemed not to have been admitted by the parties.

With the direction aforesaid, the writ petition, being WPA 19415 of 2022, is disposed of.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
