The petitioner seeks five day's pay for being absent from the school at Naktala, Kolkata.

Learned counsel for the petitioner submits that the petitioner had to come to the High Court to affirm pleadings in matrimonial litigation as also writ petition with regard to the 'A Category' Pay Scale.

This Court notice that the Leave Rules of the West Bengal Board of Primary Education do not permit any paid leave for coming to Court on personal litigation. 4.

It appears that the petitioner is personally present in Court today, which is a working day in the school. The presence of the petitioner today was not required as she is represented by sufficiently senior and competent lawyers.

The writ petition is in gross and thorough abuse of process of law. The same is, therefore, dismissed. 6.

In the facts and circumstances of the case, the petitioner is let off with a warning not to engage in such frivolous litigation in future.

There shall be no order as to costs.
