Galib Mr. Abu Siddique Mallik ... for the State Affidavit of service filed in Court is taken on record. A report filed by the State is also taken on record. Learned advocate for the petitioner submits as follows. The petitioner got the property in question as a gift from his brother in 2022. The private respondents have been harassing and intimidating the petitioner and trying to disturb the peaceful possession of the petitioner's property. This compelled the petitioner to file a suit before learned 2nd Civil Judge, Junior Division at Basirhat, North 24 Parganas being TS Case No.396 of 2022. On 12.09.2022 the learned Civil Judge was pleased to pass an interim order to maintain status quo as regards the nature, character and possession of the suit property. Yet, violating such order, the private respondents are continuing to threaten the petitioner and trying to cultivate paddy in his land.

Learned advocate for the State relies on the report and submits as follows. The police have acted on the complaints filed by the petitioner and have already initiated two proceedings under Section 107 of the Code. The police are keeping close watch in the locality. It appears that the petitioner has filed a civil suit against the private respondents which is pending. There was an order passed by the learned Civil Judge to maintain status quo.

Let the police authorities keep a vigil at the locale and ensure that no breach of peace takes place and no order of a civil court is violated.

With the aforesaid observations, the writ petition is disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
