The maintainability of the claim case connected with the instant revisional application being Claim Case No. 18 of 2017 was challenged by the petitioner on the ground that the claimant has initiated another claim case being MACC No. 20 of 2017 for the selfsame accident.

Singh learned advocate for the petitioner submits that during the pendency of the present revisional application, the claimant has withdrawn the other claim case, rendering the challenge to the maintainability of the connected claim case infructuous.

In view of the aforesaid development, C.O. 3222 of 2018 is dismissed as infructuous without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
