It is the allegation of the petitioner that the bank obtained money from the petitioner and did not give any receipt for the same. The money transaction is in relation to a hire purchase agreement. The hire purchase agreement contains an arbitration clause so far as the claim for money is concerned. Apparently the petitioner did not initiate any arbitration proceeding. The money claim is, therefore, barred by limitation as on date. The disputes between the parties are essentially civil in nature. No interference is called for by the writ court. WPA 17442 of 2007 along with all connected applications are disposed of accordingly.
