The affidavit of service filed in Court today is taken on record.

The petitioner complains that the private respondents, in violation of the order of status quo passed by the learned Civil Judge (Senior Division), Uluberia in Title Suit No.77 of 2023, is interfering with the right of the petitioner by cutting the bamboo trees and disturbing the petitioner. A complaint was lodged pursuant to which FIR No.192 dated 1st August, 2023 was registered.

Alleging theft, assault and criminal trespass a further complaint was lodged before the police on 22nd December, 2023, but the police failed to take any step in response to the same.

The report forwarded by the Officer-in-Charge, Joypur Police Station, signed on 14th August, 2023 mentions that in response to the complaint filed by the petitioner, P.S. Case No.192 of 2023 dated 1st August, 2023 was registered and the investigation of the same is under progress.

There is nothing to suggest that the police acted in response to the second complaint filed by the petitioner in December, 2023.

The police are directed to take steps in response to the complaint lodged by the petitioner in December, 2023. The police are also directed to maintain strict vigil and ensure that there is no breach of peace at the locale. The life and property of the petitioner shall not be endangered in the hands of the private respondents.

Writ petition and the connected application are disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
